PCD 1209 Modern Slavery Police Transformation Fund S22a Agreement

  • In September 2016, the Devon and Cornwall Chief Constable and the NPCC Lead for Modern Slavery (MS) successfully bid into the Police Transformation Fund to support the introduction of a number of projects to improve the national policing response to MS. Police and Crime Commissioners have agreed to collaborate in relation to the running of the Modern Slavery Police Transformation Programme.  

  • In order to do so there has been a S22A Collaboration Agreement in place, which we have signed and renewed annually. The paper therefore requests approval to renew collaboration with the Police and Crime Commissioner for Devon and Cornwall, and others, under the updated S22A agreement in order to continue running the Modern Slavery police transformation programme in England and Wales. 

  • This agreement is retrospective and covers the period between 1st April 2021 to 31st March 2022.  

The Deputy Mayor for Policing and Crime is recommended to:   

  1. Approve a collaboration with the Police and Crime Commissioner for Devon and Cornwall, and others, under the updated S22A of the Police Act 1996. 

PART I - NON-CONFIDENTIAL FACTS AND ADVICE TO THE DMPC 

  1. Introduction and background  

  1. The Modern Slavery and Organised Immigration Crime Programme is a national project funded by a grant from the Home Office made to the PCC for Devon and Cornwall. 

  1. This S22a Agreement is a continuation of the previous programme, this programme has been running since 2017 and been signed on a annual basis ever since. The previous 2020-21 document that was signed by all 43 Chiefs and Policing Bodies.  

  1. This agreement is retrospective and covers the period 1st April 2021 to 31st March 2022, as Devon and Cornwall did not receive the relevant grant agreements from the Home Office till March 2022.  

  1. Organised Immigration Crime (OIC), which is part of the NPCC Portfolio for Modern Slavery, Organised Immigration Crime and Asylum was added to the overall programme in October 2020 with a pilot of eight forces. This has been expanded to fifteen forces at the start of the 2021-22 programme in April 2021.  

  1. Whilst the period relating to this agreement has ended, the actions of the programme may have implications beyond the end date and for this reason it is still essential that all Parties sign the agreement.  

  1. Issues for consideration  

  1. For Modern Slavery, this s22A collaboration agreement is, very much, a continuation of existing arrangements under an Agreement which has been in place since 2017. This 2021-22 agreement has only minor changes from the 2020-21 agreement, and these relate to the structure of the Programme and its strategic aims. 

  1. As part of this Agreement the Met receive two experienced members of staff at full cost recovery – a Detective Sergeant and a Detective Inspector -, funded by the Home Office. These officers represent the MPS at a national level, promote best practice and act as facilitators of communication between the MPS, other police forces, Border Force, Immigration Enforcement and other agencies. 

  Financial Comments  

  1. The costs relating to this s22A collaboration agreement are funded by Devon and Cornwall as the lead force for this programme. 

  2. Legal Comments 

  1. S22A of the Police Act 1996, as amended by Section 89 Police Reform and Social Responsibility Act 2011 allows the MOPAC, as the local policing body, in connection with the discharge of any its functions to enter into a collaboration agreement.  

  1. The MOPAC Scheme of Delegation at Clause 4.5 requires the Deputy Mayor for Policing and Crime to approve all collaboration agreements where the Act requires. As this is a policing body collaboration, it is required. 

  1. GDPR and Data Privacy  

  1. MOPAC will adhere to the Data Protection Act (DPA) 2018 and ensure that any organisations who are commissioned to do work with or on behalf of MOPAC are fully compliant with the policy and understand their GDPR responsibilities.   

  1. Equality Comments  

  1. Equalities considerations have been taken into account particularly concerning the support of vulnerable and diverse communities/victims who are at greatest risk from MS. 

  1. Whilst there is no specific Equalities Impact Assessment for the S22a Agreement, the work that the programme does, the guidance and products it produces are subject to regular EIA carried out by Devon and Cornwall.
