We are already subject to constant demolitions and these new properties are for rich foreigners - effectively this is an attempt to drive out the last remaining Londoners. Sorry but someone needs to voice to this Mayor that Londoners are not happy, the honourable thing to do would be to step down. Public health is being seriously affected. It's a company in Guernsey, for God's sake. These are all obvious points, who wants to live in a building site forever and ever? It's not normal.

- Regulation 12(4)(e) (Internal communications)
The exception to disclose applies to a small volume of emails between GLA planning officers and viability advisors and relating to a ‘live’ planning application. This falls within the definition of an “internal communication” as described in guidance issued by the Information Commissioner’s Office (ICO) [para 14]
The concept of a communication is broad and will encompass any information someone intends to communicate to others, or even places on file (including saving it on an electronic filing system) where others may consult it. It will therefore include not only letters, memos, and emails, but also notes of meetings or any other documents if these are circulated or filed so that they are available to others.
Regulation 12(4)(e) is a class-based exception, meaning there is no need to demonstrate that any harm will occur through disclosure of requested information, however consideration must be given to whether the public interest favouring disclosure of the information covered by this exemption outweighs the public interest considerations favouring maintaining the exemption and withholding the information.
The GLA acknowledges that there is a public interest in planning referrals. However, it is not in the public interest to prejudice the internal deliberation and decision-making by releasing information which would undermine the ability of officers to provide effective advice in respect of how viability can be achieved on schemes.
- Regulation 12(5)(b) (The course of justice and inquiries exception).
This exception is very wide in coverage, in this instance it is used to cover material covered by legal professional privilege (LPP). LPP exists in this instance to protect advice from lawyer to client.
For the exception to be engaged, disclosure of the requested information must have an adverse effect on the course of justice. Disclosure of the exchange between client and lawyer would undermine the public confidence in the efficacy of LPP. Regulation 12(5)(b) constitutes a qualified exemption from our duty to disclose information under the EIR, and consideration must be given as to whether the public interest favouring disclosure of the information covered by this exemption outweighs the public interest considerations favouring maintaining the exemption and withholding the information.
The GLA acknowledges that there is a public interest in transparency in relation to building safety matters, disclosure would enable the local community to understand more fully the decision-making process. However, these communications took place in circumstances where a relationship of confidence was implied, and it is in the public interest to protect the principle of Legal Professional Privilege by allowing clients to have discussions with their lawyers in confidence. The best interest of the public – i.e. the public interest – is best served by ensuring that public authorities continue to debate robustly and comprehensively, considering all options and their potential impacts, for the best possible decisions to be taken.
