In their role of making strategic planning decisions, the Mayor may occasionally take over an application, therefore becoming the local planning authority. They must then hold a public hearing before deciding whether or not to grant planning permission.

In this instance, the Mayor, Sadiq Khan, took over the application for the redevelopment of 5 Kingdom Street in Westminster.

Background to the public hearing

On 10 March 2020 Westminster advised the Mayor that it was minded to refuse permission for the redevelopment proposals for 5 Kingdom Street.

On 23 March 2020, having considered a report on the case, the Deputy Mayor for Planning, Regeneration & Skills notified Westminster that he would act as the local planning authority for the purposes of determining the planning applications (under article 7 of the Mayor of London Order and the powers conferred by Section 2A of the 1990 Town and Country Planning Act).

The local authority for this case is 19/03673/FULL. The GLA reference is 4925.

The public hearing is scheduled for 29 October at 13.30.

About the public consultation

Subsequent to the Mayor’s direction, on 31 July 2020 the applicant submitted revisions to the Application, including:

  • Increasing the contribution to Westminster’s affordable housing fund to £14.3 million (from £1.75 million);
  • Increasing the affordable workspace to 3,900 sqm (GIA) and providing this in the ‘Crossrail Box’ (from 1,400 sqm), with consequent reduction of ‘flexible’ space from 7,866 sqm to 3,490 sqm;
  • Revising the energy strategy to achieve 43% carbon saving based on current modelling and achieving a net zero carbon development by maximising on site opportunities for savings up to completion and making off-site contribution measures if necessary;
  • Reconfiguring the Garden space linking Harrow Road to Kingdom Street and to the ‘Crossrail Box’;
  • Reconfiguring the office entrance and the floor plans of levels 18 and 19, with an increase in office floorspace of 570 sqm;
  • Raising the height of the lift over-runs and selected rooftop plant by 4.32m above the parapet (which is retained at the same height originally proposed).

Hard copies of documents are not available to view, and representations by letter are discouraged, in line with Town and Country Planning (Coronavirus) Regulations 2020. If you intend to make representations of objection or support in respect of the revisions to the Application and/or the other information relating to the Environmental Statement these should be sent by email to the Greater London Authority at [email protected] by 12 September 2020.

The application will not be decided before this consultation period ends. Comments received after this date, but before a decision is made, may still be taken into account; but failure to meet this deadline could result in your comments not being considered. Any representations you have previously made on this application to the City of Westminster Council will still be taken into account.
